The Department of Labor (“DOL”) just issued its long-anticipated Notice of Proposed Rulemaking regarding overtime pay. The new rule proposes an increase to the existing salary threshold for employees to be eligible for overtime pay under the Fair Labor Standards Act.
Currently, employees who make less than $23,660 a year (or $455 per week) are entitled to receive overtime. The DOL’s proposal would increase this salary threshold to employees who make less than $35,308 a year (or $679 per week). According to the DOL, this increase would expand overtime eligibility to more than one million additional workers.
